Odd developments up here, relative to the Iraq war. We've got 200 US deserters who have claimed refugee status. There's probably alot more just hiding out. Many appear to be OK with the war in Afghanistan, but have refused deployment orders to Iraq (where some have already been). Most have tried to apply for CO status in the US, and been denied (apparently its been almost impossible since the early 90s to get CO status). Many are NG or Reserve, and are fleeing 'stop loss' measures (i.e. you can't quit) and four year federalisations, or regulars who have finished their obligation and been extended or called back immediately as reservists.
To date, we've mostly been denying refugee status and sending them back, right to Leavenworth. Recently, however, the Ontario Appeals Court granted a 'stay' in one case and claimed jurisdiction over his claim. For the euchre players out there, that's sort of like dropping a jack of trumps on somebody's nine (refugee tribunal). He's apt to be accepted, which would create one hell of a precedent for the others. Meanwhile, the refugee people are working over time to push the others back across the border before the implications of this ruling can register.
General population appears of two minds. I'd characterise it this way: the dopes, who think that Iraq and Afghanistan are part of the same effort and who don't really understand the other issues (near impossibility of getting CO status -- in one case, currently under examination up here a member of the 82nd Airborne who had been to Iraq and Afghanistan, married a Quaker and converted. He will still go to Afghanistan, but not to Iraq. He applied for CO status, and was refused. He deserted when order to Iraq. This is a first so far as I know. The Quaker position is pretty clear, and it strikes me that he was being mighty accommodating). They are all for sending these guys back. The others appear to think its rather odd to refuse refugee status to people who will be imprisoned if returned, given that their claim for CO has been refused . . . and that their claim is generally rooted in what's officially Canada's own foreign policy position (i.e. that the Iraq war is fully separable from the War on Terror, and that its an illegal war conducted outside the UN Charter, by some pretty questionable means towards gamey ends).
Interesting to see how this will play out.
